This Privacy Policy explains how we collect, use, disclose, retain, and erase any Personal Information that identifies you or makes you identifiable when you use our Website, Services, or provide it to us directly. We will only use or share your Personal Information as stated in this Privacy Policy. We use your Personal Information to provide and improve the Website and Services. By using the Website, Services, or providing us with your Personal Information, you consent to our collection and use of your Personal Information in accordance with this Privacy Policy. 

 

Who is allowed to access and utilize our Website and Services?

While certain sections of our Website may be accessed by any visitor, access to our Services is not open to the general public. Only individuals or organizations that are eligible to enter into agreements with us (our "Clients") may, with our permission, access private areas of our Website. All Clients are businesses and access to our Services is restricted to adults only. By using the Website and/or the Services, you acknowledge and agree to this Privacy Policy. 

 

Collecting and Using Personal Information

We may ask our clients who utilize our services to provide us with certain personal information that can be used to identify or contact them (“Client Personal Information”). This may occur in various situations, such as when a client browses our website, makes an inquiry on the website, creates a user profile and password for their Termzy account, subscribes to Termzy's newsletters or other updates, or signs up to attend an event (such as a webinar or other Termzy-hosted or sponsored event). 

The Client Personal Information we collect and use may include, but is not limited to, the following: name, postal address, business email address, phone number, and employer. This information is used for the following purposes: 

  • verify your identity; 
  • support and facilitate your use of our website and services; 
  • provide access to our services; 
  • offer services to our clients;  
  • provide information and respond to your requests; 
  • send you information about other products and services we offer and updates on Termzy events; 
  • conduct marketing analysis, improve and maintain our website and services, and troubleshoot any issues; 
  • prevent fraudulent use of our website and services and take action against Termzy such fraud or violations of our terms of use or relevant laws; 
  • customize your experience on our website and services; 
  • disclose any other purposes for which we will use your personal information at the time of requesting it and with your consent. 

If you provide us with your personal information through our website for the purpose of inquiring about our services, organization, or an event or information listed on our website, we will use that information to contact you in response to your specific inquiry. We may also ask if you would like to be added to our mailing list to receive updates and news about our company and services. If you no longer wish to receive these updates, you can use the "unsubscribe" function in our electronic communications or contact us using the information provided in the "Contact Us" section of this privacy policy. 

Termzy does not share or sell Personal Information to any individuals or companies, except in the case of providing Services to your clients. Personal Information about you will not be disclosed to any individuals or companies that are not affiliated with Termzy, unless in the following circumstances: 

  • to comply with subpoenas, court orders, or legal processes, or to establish or exercise our legal rights or defend against legal claims; 
  • to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, or violations of Termzy’s terms of use, any agreement with Termzy or this Privacy Policy, or as otherwise required by law; 
  • when your Personal Information has been disclosed through legitimate and public channels, including news and press channels and governmental disclosure channels; 
  • if Termzy sells any or all of its assets or its shareholders sell any or all of their shares to a third party. In this case, and subject to compliance with applicable data protection legislation, you authorize the transfer of your Personal Information to the buyer. 

We may process the personal information of our clients' visitors and customers, as well as visitors to our client's websites or downloads of our client's applications, as part of the services we provide on behalf of our clients. In this context, we act as a service provider or data processor according to applicable laws. The personal information may include IP addresses, account or membership numbers (without a way to personally identify you), and/or email addresses. If our clients send us email addresses, we request that they encrypt them before sending them. We take security measures to protect all personal information, including by hashing IP addresses and encrypting email addresses. We do not associate personal information with individuals and follow our client's instructions regarding the collection and use of this personal information. As a vendor for our clients, we may collect and process the personal information of their customers and visitors with their consent, to fulfill our client's legitimate interests, or for a lawful business purpose in accordance with applicable law. 

Termzy does not disclose Personal Information about you to any third parties except our Client who is utilizing our Services (acting as the "business" or "controller") and our Affiliates. Personal Information is not rented or sold by Termzy, except in the following circumstances:

Correcting and Obtaining Your Personal Data

You can access your Personal Information through our Client online accounts (“Client Portals”). You can use these portals to update and correct your Personal Information. If you no longer have access to the Client Portals, you can request to have your Personal Information removed by emailing contact@termzy.io or contacting us by phone or mail (as specified in the "How to Contact Us" section of this Privacy Policy). We will take reasonable steps to verify your identity before removing your information to protect your privacy and security.

We reserve the right to retain and use your Personal Information as needed to fulfill our contractual obligations to you and to comply with applicable laws, including privacy and data protection legislation.

If you are not a client but have signed up to receive information from us and want to be removed from our mailing lists, you can use the "unsubscribe" instructions in our newsletters or electronic communications, or email your request to contact@termzy.io or contact us by phone or mail (as specified in the "How to Contact Us" section of this Privacy Policy).

If you are a customer of one of our clients, or if you have visited their website or downloaded one of their applications, please contact the client to request access to, correct, or delete your Personal Information. If you contact Termzy, we may not be able to associate the data we process on behalf of our clients with any specific individual, and we may not be able to verify whether we have your Personal Information. Termzy collects information that your browser or device sends when you visit our website or use our services for our clients. This information, known as Log Data, may include your computer's IP address, browser type, browser version, the pages you visit on our website or services, the date and time of your visit, the time spent on those pages, your activity on those pages, and other statistics. We may also use third-party services, such as Google Analytics, to collect, monitor, and analyze this information to improve the functionality of our services. These third-party service providers have their own privacy policies that outline how they use this information. When you access our services through a mobile device, we may collect certain information automatically, including the type of mobile device you use, the device's unique ID, the IP address of the device, the mobile operating system, the type of mobile internet browser you use, your location information, and other statistics. Please refer to the section on Location Information for more information on the use of your location information and your options.

For our clients, the Log Data we collect for visitors to their websites or mobile applications includes the visitor's IP address, browser type, browser version, and the ads they interact with. If you are referred to another website or application from one of our client's ads and take an action, such as making a purchase or signing up for a newsletter, we may receive information about it. Termzy does not receive your personal information, such as your name, address, or credit card information.

Termzy may collect and store information about the location of its clients and their visitors, depending on the permissions set on the relevant device. This information is used to provide features of the services and to improve and customize them. For visitors to the website and clients' visitors, location information is collected to attribute actions to specific clients and for fraud prevention. You can enable or disable location services through your device settings.

In addition to log data, Termzy uses cookies to collect information and improve its website and services. Cookies are small data files that may include an anonymous unique identifier, and they are sent to your browser from a website and transferred to your device. You can instruct your browser to refuse all cookies or to notify you when a cookie is being sent. The "Help" feature on most browsers provides information on how to accept or disable cookies. If you do not accept cookies, you may not be able to use some features of the website or services (or clients' websites). It is recommended to leave cookies turned on.

 

Integrations

As a client, you have the option to improve the Services by connecting them to third-party products through Termzy integrations. If you allow us access to your third-party accounts by providing us with the necessary credentials, you understand that some of the content and/or information from those accounts (referred to as "Third Party Account Information") may be transferred to your account with us and will be protected by this Privacy Policy. Additionally, the Termzy software may request permission to perform actions on your behalf using your third-party account credentials. 

 

Third-Party Service Providers

We may hire third-party companies and individuals (our "agents") to help us provide our Services, perform service-related tasks, or assist us in analyzing how our Services are used. For example, they may process and store data, send messages, process credit card payments, analyze data, provide marketing assistance, and supplement the information you provide to us in order to improve our service to you and provide customer service. These third parties have limited access to your Personal Information and are under a written obligation not to disclose or use it for any purposes other than those outlined in this Privacy Policy. We do not share your data with non-agent third parties, except as stated in the "Personal Information Collection and Use" section.

Although we have legal and contractual obligations with our agents, we are still potentially responsible for any misuse of your Personal Information.

 

Retention and Deletion

Termzy only keeps Personal Data for as long as it is needed to provide its Services. The Personal Data of our Client's visitors is automatically deleted or anonymized after ninety days. If we receive a request to delete Personal Data before it is automatically deleted, we follow a process to verify the authenticity of the request. This includes confirming that the requestor is the individual whose data it is or, if the request comes from a Client about its visitors, deleting the Personal Data as instructed by the Client. Since we do not collect personally identifiable information of our Clients' visitors, we may not be able to verify or match a request with a particular Client if the information comes directly from the visitor.

When deleting Personal Data, it is completely removed from our servers or only retained in anonymized form. If we have collected Personal Data about you from multiple Clients, we will delete all instances of the Personal Data that we have at the time of the request (to the extent that we can verify and match it). However, if you later authorize or visit the same or another Client's website or application, we will process your Personal Data in relation to that authorization or visit.

 

Privacy Policy Modifications

It is within our discretion to update or alter our Privacy Policy at any point in time. To stay informed of these changes, we recommend checking our Privacy Policy regularly. By continuing to use our website and/or Services after we have made any modifications to the Privacy Policy, you confirm that you have acknowledged and agree to follow the modified terms. If there are any significant changes to this Privacy Policy, we will notify you either through the email you have provided us or by posting a noticeable notice on our website.
